Bakgatla Kgosikgolo warrant of arrest still valid

08 Mar 2017

The warrant of arrest against Bakgatla Kgosi Kgolo is still valid because a Court order once issued remains valid and enforceable unless it is rescinded by the Court that issued it, in this case being the Village Magistrate Court.

Minister of Defence, Justice and Security Mr Shaw Kgathi said this in Parliament on March 7, in respose to a question from the MP for Mochudi West, Mr Gilbert Mangole.
Mr Kgathi said it might also be rescinded by a higher Court being the High Court or Court of Appeal.

Furthermore, he said the warrant of arrest might be set aside through due process which entails the concerned party subjecting himself to that process.
Mochudi West legislator had asked the minister whether the warrant of arrest imposed on Bakgatla Kgosi Kgolo was still valid and if so, what would it take government to trigger the removal of the warrant to enable Kgosi Kgolo to visit his tribe in Botswana as he wishes. ENDS
