Law Society appeals High Court decission

Minister of Defence, Justice and Security, Mr Shaw Kgathi has told Parliament that Law Society of Botswana and Attorney General's Chambers failed to deal with a case of a dispute involving plot 46 in Notwane.


He said the disciplinary committee of the Law Society dealt with the matter and handed a verdict of guilty of professional misconduct, imposing a fine of P7500 on the attorney concerned.


He further said the attorney lodged a review application with High Court against the decision of the disciplinary committee.


He said the application was successful with the result that verdict was set aside.


Minister Kgathi said Law Society of Botswana has taken the decision of the High Court on appeal. He said Attorney General was aware of the complaint and referred the enquiries of the complaints to the Law Society of Botswana, who is the appropriate authority under the law to deal with it.


He said the attorney General did not therefore fail to resolve the matter.


He was responding to a question asked by Ramotswa MP, Mr Samuel Rantuana who had asked if it was true that Botswana Law Society failed to take action against one lawyer mishandling a case involving conflict at plot 46 in Notwane in which he charged his clients for court appearances that he never attended in 2008/2009.


He also asked if the minister was aware that the dispute has reached Attorney General's Chambers who also failed to resolve the matter. ENDS
