Accused farmers engage another attorney

A trial in which five farmers have been charged with assaulting and injuring two men at Diagane lands sometime in 2013, has been adjourned to October 10.

Appearing before Chief Magistrate Faith Dlamini-Ng’andu in Molepolole on September 6, the accused confirmed that they had engaged Toteng and Company after losing confidence in the previous attorney’s representation.

They pleaded with the court to consider further postponement after they countlessly tried to consult the lawyer but did not succeed.

Meanwhile, the newly engaged attorney excused himself earlier saying he had an emergency.

However, the prosecutor, Assistant Superintendent Magosi confirmed to court that the attorney made it to court, but had an emergency.

Magistrate Ng’andu however raised a concern with delay in the matter due to the accused’s change of attorneys.

She said the case would proceed as scheduled, ordering the accused persons to inform their attorney to check with clerk of court in order to familiarise himself with the case record.

Prosecution was also ordered to avail all the evidence to the new council.

The five accused persons, Masego Phuduhudu and the three Kgalaeng brothers: Setoba, Balimi, Badisa  and Atamelang Molaelowapula all members of  Selelo-sa-Baruakgomo a concerned group allegedly formed to fight stock theft around Diagane jointly assaulted Morris Sekgee  suspecting him to have possessed stolen livestock.              

They would appear for mention before September 12 for confirmation of trial dates. ENDS
